In the traditional legal process, the attorney uses the legal system to advocate for the position of the client. Most cases use negotiation as a method of resolving the issues, but if agreements cannot be reached, the case is litigated before a judge who will make the ultimate decisions to resolve the case.
A traditional divorce case may need to use formal legal procedures, such as discovery (method of obtaining documents and information), expert witnesses, depositions and court hearings or trial. If custody and placement is not resolved by agreement, the court will appoint a Guardian ad Litem to investigate and give a recommendation regarding the children’s best interests.
